The chapter begins with a brief introduction to critical race theory which looks at how societal racism shaped torts legal principles including consent, contributory negligence and assault and battery. The chapter has a selection of cases generally covered in most torts subject matter casebooks as well as law review articles discussing the cases which provide additional information that allow for a fuller discussion of the role of racism in the case. After each set of readings there are questions and notes.
